State Privacy Legislation Updates



Here is the current situation on data privacy legislation at the state level. This information was updated on May 1, 2023. Here are the highlights.


Washington Governor Inslee signed HB 1185 into law. Called the My Health My Data Act, this law is specific to health data privacy. Nevada is considering a similar bill that guards health data privacy.


In Florida, the Senate passed SB 262, regarding technology transparency. This is a comprehensive bill, similar to the Virginia bill, but with a narrower definition of who/what it applies to. A companion bill, HB 1547 has also been introduced. The Florida House also passed HB 591. This bill deals with social media protection for minors and includes some interesting provisions including prohibiting schools from using or having an account on social media platforms.


The Texas House also passed a bill, HB 18 that aims to protect minors from "harmful, deceptive, or unfair trade practices in connection with the use of certain digital services".


In California and North Carolina, there has been movement on bills addressing social media platforms. In California, SB 287 "prohibits a social media platform, as defined, from using a design, algorithm, practice, affordance, or feature that the platform knows, or which by the exercise of reasonable care should have known, causes child users to do any of certain things, including experience addiction to the social media platform". North Carolina, the Social Media Algorithmic Control in Information Technology Act, HB 644, was referred to the House Appropriations Committee. This bill states it “combat[s] social media addiction by requiring that social media platforms respect the privacy of North Carolina users’ data and not use a North Carolina minor’s data for advertising or algorithmic recommendations.”


Two bills pertaining to data brokers have also seen movement. In California, SB 362 moved to the Appropriations Committee, and in Texas, SB 2105 was voted out of the Senate Business & Commerce Committee.
